Hard money loans in Florida

Hard money is lent against the property rather than against your income documents. Investors use it here for the same reasons they use it anywhere — speed, auctions, deadlines, properties a bank will not touch — but what sets the timeline in Florida is worth knowing before you promise a seller a closing date.

What sets the clock in Florida

Title is usually the long pole, not the lender. Florida title work routinely turns up open permits from prior owners, unreleased liens, contractor claims and probate issues, and any of them can hold a closing. Order title the day you go under contract. A lender ready to fund on Thursday cannot fund against a title commitment that arrives on Friday.

Insurance binding is the second. Coverage has to be in place to close, and during hurricane season carriers frequently suspend new binding while a named storm is in the basin. That pause is outside everyone's control, and it is the single most common reason a fast Florida closing slips.

Documentary stamp tax and intangible tax are Florida particulars that surprise out-of-state borrowers at the closing table. They are real costs on the note and the mortgage, they are calculated on the loan amount, and they belong in your cash-to-close figure from the start rather than as a surprise on the settlement statement.

Open permits deserve their own mention. A property with an open permit from work done years ago — sometimes by a previous owner, sometimes never inspected — can require resolution before title will insure. It is a common Florida problem, it is solvable, and it takes time nobody budgets for.

What a Florida hard money file needs

Title ordered early

The most common cause of a missed closing date here, and the easiest to get ahead of.

Insurance quoted, not assumed

Binding must be possible. During storm season, timing matters as much as price.

A clear exit

Sale or refinance, with the arithmetic behind it. A short-term loan without an exit is a default with a fuse.

Doc stamps in the budget

Florida's transfer and intangible taxes are calculated on the loan and belong in cash to close.

Florida hard money questions

How fast can a Florida deal actually close?
When title is clean, insurance is bound and the file is complete, these move quickly. The realistic constraint is rarely the lender — it is title clearance and, in season, insurance binding.
Can you lend on a property with an open permit?
Often, but it has to be addressed for title to insure. Find out what is open before you set a closing date, because resolving it can involve the municipality's schedule rather than yours.
Do you lend on auction purchases?
Auction and foreclosure purchases are a normal use of this financing. The deposit and timing rules of the specific auction matter, so tell us which auction before you bid.
Is a personal guarantee required?
Usually yes on business-purpose investor loans, even when the borrower is an entity. It varies by lender and by file.
